1 – OBJECT
The aim of Arte Laguna World (ALW) Platform is to give visibility to artists of Arte Laguna Prize but also to others who want to show and sell their Artworks on-line (“Sellers”).
Sales are directly between the Buyer and the Seller. ALW is not, in any respect, a reseller of the Artworks proposed by the Sellers through the Site.
ALW is not a party to the contract, it acts as a simple middleman in the context providing the Site that allows Sellers and Buyers to connect. The contract is concluded only between the Buyer and the Seller of the artworks who is the only Seller and the only one bound to obligations arising therefrom.
2 – ACCEPTANCE AND GUARANTEES
ALW offers this website, including all information, tools and services available from this site to the Artist, conditioned upon the acceptance of all terms, conditions, policies and notices stated here. The simple use of the Site automatically entails the Seller’s acceptance of the Terms of Service and of Terms of Sales.
Both, the Buyer and the Seller, must accept this agreement to conclude the sale. The unconditional acceptance is mandatory and has to be made by checking the box on the Artwork order form for the Buyer and on the login area for the Seller.
The Seller guarantees that he is the author of the Artwork and that the Artwork does not violate any laws, regulations and standards in force, or affects the rights of third parties. The Seller, together with the Artwork, is required to provide the certificate of authenticity to the Buyer.
The Seller commits to respect and implement the statutory guarantees of the Buyer, i.e.: the guarantee of non-compliance and the guarantee of hidden defects.
3 – ORDER
The Artworks are offered for sale, subject to their availability, on the Seller’s dedicated page with technical description and information published by the Seller.
To order an Artwork, the Buyer selects the Artwork and provides the mandatory personal information to place the order. The order does not include packaging and delivery costs. After confirming on the order summary all details, the Buyer will not be charged for the payment before validation of the purchase offer. The validation is done within 5 working days in order to ensure the Artwork’s availability from the Seller.
If the Artwork is no longer available, the order will be cancelled and the Buyer will be informed by email.
4 – SALES PRICES AND TERMS OF PAYMENT
The Artworks sale price is published on the Artist page and it is in Euro. The sale price does not include transport and packaging costs and any customs duties if due.
The delivery and packaging costs, and custom duties if due, depend on the type of artwork, its dimensions, its weight, as well as the place of delivery. With the validation of the order, the Buyer will receive an email with the information about delivery and packaging costs.
The payment is made via credit card or bank transfer with the information sent by email.
Transfer of ownership happens as soon as the full price has been paid by the Buyer. Failure to pay the full price automatically cancels the sale, and the artwork is put back for sale on ALW’s website.
5 – DELIVERY OF THE ARTWORKS
The delivery of the Artworks is made at the address provided on the order summary form.
Obligations regarding the delivery of the order, the given schedules, the quality of the packaging, are not on ALW’s responsibility. Buyer is entitled to lodge a complaint against the delivery service provider.
The condition of the artwork must be checked when the buyer receives the order and the acceptance with reservation must be indicated immediately and at the latest within 48 hours, to ALW, who will transfer to the Seller.
Upon the sale, the Seller assigns to the Buyer the artwork and its representation rights on the artwork. The Seller however retains the moral right on the artwork as well as the rights regarding its reproduction.
6 – WITHDRAWAL
The Buyer has the right of withdrawal with the Seller within the term of 14 (fourteen) calendar days from the day on which the Artwork is received.
The Buyer may use the right of withdrawal by sending an email to the following address: withdrawal@artelaguna.world
ALW will then be responsible for handling the cancellation from the Buyer and will process the refund within 14 days from the receipt back of the Artwork.
The refund will be processed at the condition of no damages or dirty returned Artwork; ALW reserves the right to decide at its sole discretion about the conditions of the returned Artworks. Shipping costs for returning the Artwork due to the withdrawal are in charge of the Buyer.
7 – DATA PROTECTION
ALW gathers and retains the Buyer and the Seller’s personal data to ensure proper execution of these terms.
8 – APPLICABLE LAW AND COMPETENT JURISDICTION
For any controversy that might arise in the interpretation and fulfilment of this Terms and Conditions of Sales, the competent court will exclusively be the Tribunal of Treviso, Italy.
